Terms of Service

1. Service Description
PubliJet (publijet.agentevirtualia.com) is a SaaS digital marketing platform that provides tools for AI-powered content creation, social media scheduling, analytics, campaign automation, and multi-client agency management. The Service is provided "as is" and may be updated, modified, or discontinued at any time. By accessing or using PubliJet, you agree to these Terms of Service in their entirety.
2. Account Eligibility
To use PubliJet you must be at least 18 years old and have legal capacity to enter into binding contracts in your jurisdiction. By registering, you represent that the information provided is accurate, current and complete, and that you will keep such information updated. An account is personal and non-transferable; you may not share your credentials with third parties.
3. User Obligations
You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify PubliJet immediately at legal@agentevirtualia.com of any unauthorized use. You are solely responsible for the content you publish through the Service, including compliance with the policies of connected social networks (Meta, X, LinkedIn, TikTok, etc.) and applicable laws on advertising, intellectual property and data protection.
4. Prohibited Use
You agree not to use the Service to: (a) distribute spam, malware, phishing or fraudulent content; (b) post illegal, defamatory, discriminatory, sexually explicit content involving minors, or content inciting violence; (c) infringe third-party intellectual property rights; (d) perform reverse engineering, unauthorized scraping or interfere with the security of the Service; (e) resell or sublicense the Service without written authorization. PubliJet reserves the right to suspend or terminate accounts that violate these terms without refund.
5. Intellectual Property
All code, design, brand, logos, interface and functionality of PubliJet are the exclusive property of Agente Virtual IA and are protected by international copyright, trademark and trade secret laws. You retain ownership of the original content you create and publish through the Service. By using the Service, you grant PubliJet a limited, non-exclusive and worldwide license to store, process, generate AI variants, and transmit such content solely for the provision of the Service.
6. Payments & Refunds
Certain features require a paid subscription. Payments are securely processed through Stripe. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date from Settings > Billing. Charges are non-refundable unless applicable law requires otherwise; case-by-case refunds may be requested within 14 days of the first charge by writing to legal@agentevirtualia.com. Prices may be updated with 30 days prior notice.
7. Termination
You may cancel your account at any time from Settings > Danger Zone, which will permanently delete your data within 30 days. PubliJet may suspend or terminate your access to the Service immediately, with or without notice, if you breach these Terms, if there is a security risk, or if PubliJet decides to discontinue the Service. Upon termination, the sections on Intellectual Property, Limitation of Liability and Governing Law will remain in effect.
8. Limitation of Liability
To the maximum extent permitted by law, PubliJet shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of revenue, profits, data, business opportunities or reputation resulting from use or inability to use the Service. PubliJet's total cumulative liability shall not exceed the amount paid by you for the Service during the twelve (12) months preceding the event giving rise to the claim. PubliJet does not guarantee marketing results or the performance of AI-generated content.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Dominican Republic, without regard to its conflict of law principles. Any dispute related to the Service shall be submitted to the exclusive jurisdiction of the competent courts of Santo Domingo, Dominican Republic. If any provision of these Terms is found to be invalid, the remainder shall remain in full force.
